Legal Requirements

There are several requirements of the Marriage Act to adhere to. Before I can conduct your marriage, the following conditions need to be met to ensure you fall within the main legal boundaries:

  • A Notice of Intention to Marry (NOIM) must be completed and witnessed at least one month and one day prior to your wedding. It can be lodged with me up to 18 months in advance of your wedding. Couples marrying in Australia are bound by the Australian Marriage Act 1961.

  • You must be at least 18 years of age to marry in Australia. (if under 18 but over 16 years of age, a court order will be required) and the couple is not to be related (either as an ascendant or descendant)

  • If you are an Australian born citizen you must provide your birth certificate. If born outside Australia, you are required to show your birth certificate or passport from your country of birth.

  • If you have been previously married, you must provide a Divorce Decree or Death Certificate of a previous spouse.

  • When we meet, prior to the wedding, I must sight your passports, birth certificates, Divorce documents (as mentioned above) and/or Death Certificate of your previous partner.

  • You are required to have two witnesses to the ceremony – I can arrange this for you if you do not have friends or family in Sydney. After the ceremony, I will lodge all relevant papers with the NSW Registry of Births Deaths and Marriages for recording
